Terms of Service
1. Platform Nature & Disclaimer of Role
Point Click Leads LLC (“Point Click Leads,” “we,” “us,” or “our”) operates a business-to-business lead marketplace.
We are not a moving company, broker, contractor, consumer service provider, or agent of any Buyer. We do not verify Buyer licensing, insurance, or qualifications and do not control Buyer communications with consumers.
Point Click Leads does not guarantee lead volume, lead quality, conversion rates, revenue, or territory exclusivity. All interactions, services, representations, pricing, and fulfillment provided to consumers are the sole responsibility of the Buyer.
2. Eligibility & Account Responsibility
The Platform is available only to businesses operating in a commercial capacity. Buyer represents that it is a lawful business entity and agrees to comply with all applicable laws.
Buyer is responsible for maintaining account security. All activity conducted through Buyer’s account is deemed authorized by Buyer.
3. Lead Types & Distribution
Point Click Leads may offer phone call leads and web form submission leads. Leads may be designated as exclusive or shared.
Shared leads are delivered to no more than three (3) Buyers. Point Click Leads retains sole discretion over lead routing, classification, timing, availability, suppression, and throttling.
4. Lead Access & Billing Gate
Full consumer contact information is released only after successful billing. Point Click Leads may withhold, delay, restrict, or revoke access to leads at any time without notice for billing failure, fraud prevention, abuse prevention, compliance, quality control, or legal risk.
5. Billable Lead Definitions
Phone Call Leads
- Minimum duration of 60 seconds
- Must connect live to Buyer (not voicemail)
Calls may be recorded in certain instances for quality assurance, compliance, and dispute resolution.
Web Form Leads
A web form lead is billable if it meets the campaign criteria selected by Buyer at the time of delivery.
6. Pricing, Billing & Payment Authorization
All charges are pay-per-lead. There are no monthly fees and no long-term contracts. Charges are processed off-session via Stripe immediately upon lead delivery.
Buyer expressly authorizes Point Click Leads to charge Buyer’s payment method. In the event of payment failure, Point Click Leads may, at its sole discretion, retry charges, pause campaigns, restrict access, suspend accounts, or terminate service without notice.
7. No Refunds; Credits Only
All sales are final. Approved disputes may result in account credits only, not cash refunds, charge reversals, or reimbursements, unless expressly agreed in writing by Point Click Leads.
8. Disputes
Disputes must be submitted within seven (7) days of lead delivery.
- Wrong geographic location
- Delivered outside Buyer’s active hours
- Duplicate lead
- Disconnected or invalid phone number
- Spam or prank submission
All disputes are manually reviewed. All determinations are made at the sole discretion of Point Click Leads. Abuse of the dispute process may result in warnings, throttling, suspension, or termination.
9. Buyer Obligations & Acceptable Use
Buyer may not:
- Resell, redistribute, or sublicense leads
- Harass, mislead, or spam consumers
- Misrepresent affiliation with Point Click Leads
- Bypass tracking, billing, or routing mechanisms
- Use leads in violation of TCPA, privacy, or advertising laws
- Scrape or export data at scale
Buyer is solely responsible for TCPA compliance, consent management, advertising claims, consumer communications, and data security.
10. Data Retention
Buyer must delete all lead data within two (2) years of delivery unless legally required to retain it longer. Buyer bears sole responsibility for lawful data handling.
11. Indemnification
Buyer agrees to defend, indemnify, and hold harmless Point Click Leads LLC and its members, managers, officers, employees, agents, and affiliates from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Buyer’s use of the Platform or Leads
- Buyer’s communications or transactions with consumers
- Buyer’s violation of applicable laws, including TCPA and privacy laws
- Buyer’s products or services
- Buyer’s representations or omissions
- Buyer’s misuse or mishandling of lead data
- Third-party rights infringement claims
- Any dispute between Buyer and a consumer or third party
Point Click Leads may assume exclusive defense and control of any indemnified matter at Buyer’s expense.
12. Disclaimer of Warranties
THE PLATFORM AND LEADS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” POINT CLICK LEADS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Force Majeure
Point Click Leads LLC shall not be liable for any failure or delay in performance arising out of events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, riots, labor disputes, power failures, internet or telecommunications outages, third-party service failures, carrier disruptions, governmental actions, or failures of hosting, payment processors, advertising platforms, or telecommunications providers.
14. Limitation of Liability
To the maximum extent permitted by law, Point Click Leads LLC’s total liability shall not exceed $1,000 USD. Under no circumstances shall Point Click Leads be liable for lost profits, lost revenue, business interruption, or consequential or punitive damages.
15. Arbitration & Class Action Waiver
All disputes shall be resolved by binding arbitration in the State of California. Buyer waives any right to participate in class actions or representative proceedings.
16. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
17. Termination
Point Click Leads may suspend or terminate access at any time, with or without cause, without liability. Buyer remains responsible for all charges incurred prior to termination.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
19. Survival
The following provisions shall survive termination or expiration of these Terms: Platform Nature & Disclaimer of Role, Pricing & Billing Authorization, No Refunds; Credits Only, Buyer Obligations & Acceptable Use, Data Retention, Indemnification, Disclaimer of Warranties, Force Majeure, Limitation of Liability, Arbitration & Class Action Waiver, Governing Law, and any provisions which by their nature should survive.
20. Modifications
Point Click Leads may modify these Terms at any time. Material changes require re-acceptance. Continued use constitutes acceptance.
